1. ELIGIBILITY, ACCESS & ACCOUNT

1.1 Eligibility. You must be at least 18 years old (or the age of majority in your country of residence) to use the Services and make purchases. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.

1.2 Account Information. To access certain features or place orders, you may need to provide information such as your name, email, phone number, delivery address, and payment details. You confirm that all information you provide is accurate, current, complete, and that you are authorized to provide it.

1.3 Account Security. You are responsible for maintaining the confidentiality of your account login credentials and all activity under your account. Notify us immediately if you suspect unauthorized use.

1.4 No Transfer. You may not sell, transfer, assign, or sublicense your account to another person.

2. PRODUCTS & CONTENT

2.1 Product Representation. We aim to display product colors, images, and descriptions as accurately as possible. However, actual colors and appearance may vary depending on device settings, lighting, or packaging updates by brands.

2.2 Availability. All products are subject to availability. We may limit quantities or discontinue items at any time without notice.

2.3 Authenticity. We sell genuine branded cosmetics sourced from authorized suppliers and/or distributors. If any item is subject to a brand recall or regulatory withdrawal, we will contact affected customers with next steps.

2.4 Reviews & Ratings. Product ratings and customer reviews are user-generated opinions. They do not guarantee identical results for every customer.

3. COSMETICS-SPECIFIC DISCLAIMERS

3.1 Personal Use. Our products are intended for personal, non-commercial use only unless stated otherwise.

3.2 Skin Sensitivity & Allergies. Cosmetics may cause skin irritation or allergic reactions for some individuals. You are responsible for reviewing ingredient lists and usage instructions and doing a patch test before full use.

3.3 Not Medical Advice. Product content is provided for general information only and is not medical or pharmaceutical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease unless explicitly licensed and labeled as such.

3.4 Results Vary. Outcomes depend on individual skin type, routine, and usage. We do not guarantee specific results.

3.5 Storage & Expiry. Follow storage instructions on packaging. We are not responsible for product degradation due to improper storage after delivery.

4. ORDERS & CONTRACT FORMATION

4.1 Offer to Purchase. When you place an order, you are making an offer to buy products. We may accept or decline orders for any reason, including stock limitations, pricing errors, suspected fraud, or delivery restrictions.

4.2 Acceptance. The order is accepted only when we send an order confirmation and successfully process payment (or confirm Cash on Delivery where offered). At that point a binding contract is formed.

4.3 Order Changes/Cancellations. Please review your cart carefully before placing an order. Once accepted, cancellation or changes may not be possible. If cancellation is possible, it will be handled under our Refund/Return Policy.

4.4 Resale Prohibited. Purchases are for personal or household use only. Resale or commercial export without our written consent is prohibited.

5. PRICES, PAYMENT & VAT

5.1 Pricing. Prices are shown in AED unless stated otherwise. Prices may change without notice. The price charged is the one displayed at checkout.

5.2 VAT. Where applicable, UAE Value Added Tax (VAT) will be included or shown at checkout as required by UAE law.

5.3 Shipping/Customs. Prices exclude delivery fees, customs duties, or import taxes unless stated. International customers are responsible for their local customs charges.

5.4 Payment Methods. We accept the payment options shown at checkout. You confirm you are authorized to use the selected payment method. We may use third-party payment gateways compliant with UAE Central Bank requirements.

6. SHIPPING, DELIVERY & RISK

6.1 Delivery Areas. We deliver to locations shown on our checkout page. We may refuse delivery to certain locations due to courier or legal limitations.

6.2 Delivery Times. Delivery times are estimates only. Delays may occur due to couriers, customs, weather, peak periods, or events outside our control.

6.3 Risk of Loss. Risk and title pass to you upon delivery to the address provided (or upon handover to the courier for international shipments, where legally applicable).

6.4 Incorrect Address. You are responsible for providing a correct delivery address and contact number. Additional re-delivery or return shipping costs due to incorrect details may be charged to you.

7. RETURNS, REFUNDS & CONSUMER RIGHTS

8.1 Promotions may be subject to separate terms (validity periods, exclusions, minimum spend, etc.). If promotion terms conflict with these Terms, promotion terms prevail.

8.2 We may cancel promotions or correct discount errors at any time.

9. INTELLECTUAL PROPERTY

9.1 All content on the Services—logos, trademarks, text, images, videos, layouts, product listings, and software—is owned by or licensed to Xbeauty and protected by UAE and international intellectual property laws.

9.2 You may use the Services only for personal, non-commercial purposes. You must not copy, reproduce, distribute, modify, or exploit any portion of the Services without our prior written consent.

9.3 Brand names and third-party trademarks remain the property of their respective owners.

10. OPTIONAL TOOLS & THIRD-PARTY LINKS

10.1 We may provide tools or links operated by third parties (including embedded services). We do not control or guarantee these third-party services.

10.2 Use of third-party sites/tools is at your own risk and subject to their terms.

11. RELATIONSHIP WITH SHOPIFY

Xbeauty is powered by Shopify, which enables us to provide the Services to you. However, purchases you make are made directly with Xbeauty. You acknowledge Shopify is not responsible for any aspect of sales between you and Xbeauty, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims arising from transactions with Xbeauty.

12. PRIVACY & DATA PROTECTION

12.1 Our collection and use of personal data is described in our Privacy Policy [insert link]. We process data in line with applicable UAE data protection and e-commerce requirements.

12.2 By using the Services, you consent to the collection, use, transfer, and storage of your data as described in the Privacy Policy, including transfer to service providers that may be located outside the UAE.

13. FEEDBACK & USER CONTENT

13.1 If you submit reviews, comments, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free license to use, reproduce, and display such Feedback for operating and promoting our Services.

13.2 You confirm that your Feedback does not infringe third-party rights and is not unlawful, abusive, or misleading. We may remove Feedback at our discretion.

14. ERRORS & CORRECTIONS

We may correct typographical errors, pricing errors, or inaccuracies at any time. If an order is affected, we may cancel it and refund you.

15. PROHIBITED USES

You agree not to misuse the Services, including:

  • violating laws or regulations

  • infringing intellectual property

  • transmitting malware or scraping the site

  • harassing or defrauding others

  • attempting unauthorized access

We may suspend or terminate access for violations.

16. TERMINATION

We may terminate or restrict your access at any time without notice if you breach these Terms. Sections that should survive termination will remain in effect.

17. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by UAE law, the Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

Some warranties may not be excluded under UAE Consumer Protection laws; those statutory rights remain unaffected.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Xbeauty and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, punitive, or consequential damages arising from your use of the Services or products.

Nothing in these Terms excludes liability that cannot be excluded under UAE law.

19. INDEMNIFICATION

You agree to indemnify and hold harmless Xbeauty, Shopify, and their affiliates from any claims or losses arising from your breach of these Terms, misuse of the Services, or violation of any law or third-party rights.

20. SEVERABILITY

If any provision is held invalid, the remaining provisions will continue in full force.

21. WAIVER & ENTIRE AGREEMENT

These Terms, together with referenced policies, form the entire agreement between you and Xbeauty regarding the Services.

22. ASSIGNMENT

You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.

23. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai.
Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.

24. CHANGES TO TERMS

We may update these Terms from time to time by posting the revised version on our website. Changes take effect on the “Last updated” date above. Continued use of the Services means you accept the updated Terms.
